Foreign Companies can claim for paid German VAT. Please consider a court decision that only original invoices entitle for a VAT refund.
Foreign companies can apply for refunding German VAT as long as they are not registered for VAT purposes in Germany. The finance court Cologne (FG Köln dated Nov. 13, 2003, EFG 2004, 382) ruled that a refund is only possible if the applicant proofs the payment of the German VAT through an original invoice. No copy will be accepted. Please note that the invoice must be turned in before the deadline of June 30.
